These Terms of Service ("Terms") govern your use of 52 Build, including the website 52-build.com and the 52 Build construction project management platform, including the web application at app.52-build.com, the 52 Build iOS application, and related services (collectively, the "Service"), operated by Second Star Properties LLC ("Second Star Properties," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
To use 52 Build, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at contact@52-build.com if you suspect unauthorized access to your account.
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
52 Build provides tools for construction project management, including project tracking, estimating, contract generation, scheduling, client communication, and field documentation. You may use the Service for your legitimate business purposes in accordance with these Terms.
You retain ownership of all data you create, upload, or input into 52 Build, including project information, documents, photos, audio recordings, estimates, and contracts ("Your Data"). We do not claim ownership of Your Data.
You grant us a limited license to use Your Data solely for the purposes of operating, maintaining, and improving the Service. This includes processing Your Data through our third-party service providers (Supabase, Deepgram, Anthropic) as described in our Privacy Policy.
You are responsible for the accuracy and legality of Your Data. You represent that you have the necessary rights to upload any content to the Service and that Your Data does not infringe the intellectual property rights of any third party.
52 Build uses artificial intelligence to assist with generating scope items, daily log summaries, project narratives, and other content. AI-generated content is provided as a starting point and should be reviewed and edited by you before use. We do not guarantee the accuracy, completeness, or legal sufficiency of AI-generated content. You are solely responsible for reviewing and approving all content before it is shared with clients, subcontractors, or used in contracts.
When you invite clients, subcontractors, or team members to a project, you control what information they can access based on their role. You are responsible for managing access to your projects and ensuring that invited participants are authorized to view the shared information.
When a subcontractor or client accepts a project invitation, they agree to these Terms as they relate to their use of the Service.
52 Build provides tools for generating contracts, estimates, change orders, and other project documents. These tools are designed to assist with document creation and are not a substitute for legal advice. We do not guarantee that any document generated through the Service complies with applicable laws or regulations in your jurisdiction. We strongly recommend having an attorney review any contracts or legal documents before execution.
Access to certain features of the Service may require a paid subscription. Subscription terms, pricing, and billing details will be presented to you at the time of purchase. We reserve the right to change pricing with 30 days' advance notice. Subscription fees are non-refundable except as required by applicable law.
We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.
To the maximum extent permitted by law, 52 Build and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless 52 Build, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
The Service, including its design, features, code, branding, and documentation, is owned by 52 Build and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
You may cancel your account at any time by contacting us at contact@52-build.com. Upon cancellation, your data will be preserved for 90 days (as described in our Privacy Policy) before deletion.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a way that could harm other users or the Service itself. We will make reasonable efforts to notify you before termination except in cases of severe or urgent violations.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
These Terms are governed by the laws of the State of Tennessee. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Williamson County, Tennessee.
Program: project text messages from Second Star Properties LLC (52 Build): project updates, documents to review or sign, portal invitations, and replies to your inquiries.
How to join: check the text-message box on our contact form or on your project invitation page, or text us first.
Frequency: varies by project. Cost: message and data rates may apply.
Opt out: reply STOP to any message. You will get one confirmation and no further texts. Reply START to join again.
